BoardStock Sues Resort

The creator of the BoardStock extreme sports event scheduled for Konocti Harbor Resort & Spa in northern California last month is suing the resort for canceling his event and allegedly swiping its concept for a similar event.

Attorney Dan Beck, representing Rob Stimmel of BoardStock Promotions, filed a preliminary injunction to halt Konocti Harbor’s "X.S. Weekend" event scheduled for September 1-2.

Beck said the late Boardstock cancellation caused a hardship on his client and that the resort had an "unfair advantage" in promoting a similar event.

A judge disagreed, saying the injunction paperwork didn’t include the proper documentation, and the event went forward as planned, according to the Lake County Record-Bee.

The "X.S. Weekend" of extreme skydiving, motorcross, jet ski stunts and more also featured concerts by Toby Keith, Miranda Lambert and Kid Rock.

The dispute reportedly began mid-February, when Stimmel claims Konocti Harbor President and CEO Greg Bennett notified him that the resort, which had hosted BoardStock for the last two years, decided to drop the mid-August event. The promoter claimed his festival is unfairly blamed for attracting underage drinkers and said resort security is responsible for keeping tabs on them, according to the Lake County News.

Stimmel is reportedly seeking $300,000 in damages in a civil suit.

Bennett told Pollstar that Konocti officials did feel there were problems related to hosting BoardStock and made the decision accordingly.

"After hosting BoardStock in 2005 and 2006, and supplementing this wakeboard event with our traditional concerts and special events during that time frame, we declined for numerous reasons to continue the relationship," Bennett said. "[It was] due, in part, to the underage audience it attracts and past ABC citations issued during each of the last two BoardStock events.

"With regard to the BoardStock allegations regarding our annual Labor Day ‘X.S. Weekend’ … the event was a tremendous success as it has been for the last 10 years. We believe the judge’s ruling in our favor should speak for itself."

Meanwhile, Stimmel found a new location for BoardStock XII, according to the News.

The Big Valley Rancheria’s Konocti Vista Casino, Resort & Marina in Lakeport, Calif., is set to host the September 27-30 event.
