CME Enterprises reportedly booked Gabriel for a Cinco de Mayo show in 2005 at the Thomas & Mack Center in Las Vegas. When roughly 1,000 people showed at the 18,500-capacity venue for the concert, Gabriel failed to take the stage.

CME filed suit claiming breach of contract and later obtained a court order to freeze the singer’s bank account.

Gabriel, who claims there was no contract, attempted to appeal the freeze on the account, challenging the sufficiency of a $10,000 bond CME posted for the case.

However, since the singer waited 15 months to make his appeal after CME filed charges, he missed the five-day legal window to challenge the freeze, the court said.
