Twiin Battles Lawsuit

The legal battle between Santa Barbara, Calif.-based Jacalyn Kane Productions and Southern California promoter Twiin Productions stemming from the 2008 West Beach Music & Arts Festival has yet to be settled.

Kane’s lawsuit, filed in August 2009, alleges Twiin principals Jeremy and Joshua Pemberton recruited her to help bring acts with name recognition to the three-day event, which included Jason Mraz, Kate Voegele and Jackie Green, and has yet to be paid.

Kane also claims that after the two companies formed a ticketing company, Twiin allegedly used it as a model to create an alternate ticketing company to divert ticket sales and cut her out of her share.

Kane is seeking about $500,000 in damages and legal fees.

Twiin Productions denies the allegations and filed a countersuit, claiming Kane has been paid and her lawsuit is just sour grapes, according to the Daily Sound. Twiin reportedly argues that Kane was paid $35,000 following the festival, and accuses her of failing to bring in sponsors, provide marketing or help bring in additional talent.

“Despite payment being made in full, Kane continued a frivolous and obvious scratching at opportunity to further her agenda in hopes of even more financial gain,” Jeremy Pemberton said in a statement. “Twiin’s filing brings to light the methodic and devious attempts of Kane to gain control of the West Beach Festival, and ultimately her attempts to conspire and take over and steal the festival.”

Pemberton also said the second ticketing company referred to was formed long after the business arrangement with Kane ended, the paper said.

Kane responded to the allegations, telling Pollstar, “[The Pembertons’] claims are absolutely frivolous and baseless. They are simply an attempt to try and discredit the original suit against them. I look forward to the truth being revealed in court.”

A case management hearing has reportedly been scheduled for Feb. 22.
