Kimbrough Copyright Suit Dismissed

A long-standing copyright lawsuit between Kinney Lee Malone, son of the late Junior Kimbrough, and Fat Possum Records over the use of songs recorded by the pair has been dismissed in a Mississippi court.

Malone, who played drums for Kimbraugh’s band The Soul Blues Boys, sued Fat Possum in 2008, claiming the label hadn’t sought permission to use several tracks.

The suit alleged that Malone was owed $1 million plus royalties for songs that were included on two albums and in the 2005 movie “Hustle & Flow.”

However, Fat Possum claimed it held no contract with Malone, who wasn’t entitled to royalties for his role as a hired musician on the recordings.

Details regarding a settlement were not disclosed.
