Rush Sued For Postponement

Christopher Langone of upstate New York reportedly filed the class-action lawsuit against promoter Live Nation and the band members after Rush’s July 7 concert at Charter One Pavilion at Northerly Island was postponed because of rain.

Langone’s lawsuit filed in Cook County Circuit Court claims the concert was promoted as a “rain or shine” event and he wants reimbursement of his expenses including $480 for six tickets.

“I traveled here to Chicago to see the show with old friends,” Langone told the Chicago Sun-Times. “I’ve been a lifelong fan of Rush and we were very disappointed they canceled the show … especially when [the rain] stopped.”

Langone defended his decision on therushforum.com July 10, claiming he filed the lawsuit because StubHub told him refunds would be given out only if the show is canceled, not rescheduled.

Meanwhile, Rush’s website says the July 7 concert has been rescheduled for Aug. 23 at Charter One Pavilion. Previously purchased tickets will be honored for the rescheduled show or refunds will be given at point of purchase through Aug. 22.

Langone, a Ph.D student, had expressed concern that a rescheduled concert could conflict with his return to class at Cornell University.
