Creed Sued For Buzz Kill

Red Mountain Entertainment and Blue Deuce Entertainment, well-established promotion companies based in Birmingham, Ala., and Mandeville, La., respectively, are suing Creed Touring, the company that handled Creed’s reunion tour.

The promoters, who produced much of the 2009-10 tour, claim they are out at least $2.7 million because Creed did not help build a buzz for the tour as contractually obligated.

According to the lawsuit, Creed Touring and the band’s longtime agent, The Agency Group’s Ken Fermaglich, told Red Mountain and Blue Deuce on several occasions that the band was securing “big looks” – aka national morning talk show and late-night talk show appearances like “The Today Show” and “Late Night With David Letterman.” Instead, the promoters claim they were denied the knowledge that the band’s record label actually prohibited those appearances.

Neither TAG nor the record company are defendants in the lawsuit.

Because Creed was allegedly not allowed to do high-profile television appearances, plaintiffs claim the tour dates did not have necessary promotion needed to attract fans.

“As a result of the misrepresentations and breach of their agreement, Creed’s Reunion Tour was a financial bust,” the lawsuit claims. “In particular, Fermaglich and Creed failed to disclose that Creed’s record label prohibited Creed from performing any ‘big looks’ for the Reunion Tour and rather was requiring Creed to ‘save’ the ‘big looks’ for the release of creed’s new album. This affected Creed’s ability to perform its obligations to Plaintiffs.”

Red Mountain and Blue Deuce promoted shows at BOK Center in Tulsa, Sprint Center in Kansas City, BJCC Arena in Birmingham among other dates. Live Nation promoted some legs of the tour, as well.
