David Schubert was arrested by a Las Vegas police patrol officer May 19 in Las Vegas after the officer saw what he thought was a drug transaction and stopped Schubert’s vehicle, police told the Las Vegas Review-Journal.

With Schubert as prosecutor, Mars pleaded guilty to felony cocaine possession and was sentenced to a year of informal probation. Hilton pleaded guilty to two misdemeanors and was sentenced to probation.

District Attorney David Roger told the paper Schubert, a chief deputy district attorney, was also assigned to a federal drug task force. He said he worked with detectives to secure warrants for a blood sample and for Schubert’s two Las Vegas homes.

“It’s disheartening to know the individual who I assigned to prosecute high-level drug cases is allegedly using rock cocaine,” Roger told the Review-Journal. “His future is bleak with the district attorney’s office.” Schubert was suspended and is in the process of being terminated, Roger said.

David Chsenoff, who represented Hilton and Mars in their respective cases, was not accusatory.

“I’m a big believer in the Constitution,” Chesnoff told the paper. “I believe everyone is innocent until proven guilty. And I always root for the underdog.”

Schubert also prosecuted New York-New York casino shooter Steven Zegrean, who was convicted for a 2007 attack that left four people wounded, the paper said.
