Gayngs – which features members of Solid Gold, Bon Iver, The Rosebuds and Megafaun – was forced to cancel its Oct. 10, 2010 set at Austin City Limits Music Festival when they discovered early that morning that their leased tour bus was missing with all of the group’s musical equipment and gear inside. According to the Minneapolis Star Tribune, when the indie rock band reported the bus stolen at 4:20 a.m., the bus’ driver was also nowhere to be seen.

In October CJ Curtsinger of C.J. Starbuses told the Tribune the bus went missing because Gayngs was days late paying a $6,000 bill. He said he warned the band it had 45 minutes to unload their equipment before the driver returned the vehicle to Nashville, Tenn.

The band’s $100,000 settlement was awarded as compensatory and punitive damages in the trial of Gayngs LLC v. C.J. Starbuses, Inc. and C.J. Curtsinger.

According to a press release sent out by Gayngs’ representatives, the recent trial proved that the tour bus company engaged in “unfair and deceptive practices and that they maliciously prevented Gayngs from performing its concert at the 2010 Austin City Limits Music Festival.”

The press release clarified that the bus was sent back to Nashville without warning or notice, and that Curtsinger refused to return the bus to Austin after numerous requests from the band.

Gayngs manager Nate Vernon had the following statement to add about the whole ordeal:

“I am extremely relieved that the jury understood the turmoil, both emotionally and financially, the band has gone through as a result [of] being forced to cancel our ACL performance. No amount of money can make up for being deprived of that show; however, the peace of mind which comes from justice is the next best thing.”

Gayngs perform Saturday in Portland, Ore., at Doug Fir Lounge, followed by a Sunday set at Sasquatch! Music Festival in Quincy, Wash. A handful of California dates are booked June 1 and 3-4.
