Another All Good Suit
The All Good Festival in West Virginia is facing additional legal action stemming from a campground accident at the event in July.
A lawsuit recently filed by Elizabeth Rose Doran in U.S. district court in Clarksburg follows two other suits in alleging negligence on the parts of the event producer Walther Productions, venue owner Marvin’s Mountaintop and others.
Doran was injured when a truck lost control and careened 30 or 40 feet down a hill, striking two other vehicles before plowing into a tent that contained her and two other women. One of the women, Nicole Miller, was killed. The other, Yen Ton, allegedly suffered nerve damage.
Ton and the Miller family filed similar suits last month that claimed the defendants didn’t exercise enough care in directing the placement of tents and vehicles and keeping the premises of the festival site safe.
The driver of the vehicle, who’s also been targeted by the suits, has not been charged and authorities told the local Dominion Post there was no indication that drugs or alcohol played a part in the accident.
However, attorney Bob Martin, who represents Tim Walther of Walther Productions, recently told Pollstar sheriff’s investigations into the accident are still ongoing and “there have been significant revelations of late that could impact the case.”
