Argentine promoter 4G Producciones is suing Texas-based promoter Gabe Reed of Gabe Reed Productions for alleged non-payment of $90,000 that 4G fronted to transport Mötley Crüe’s equipment to Buenos Aires, Argentina, in May.
The lawsuit, filed Feb. 9 in U.S. District Court in Dallas, claims that under the production agreement GRP was responsible for all costs, including equipment transportation, associated with Mötley Crüe’s South American tour excluding Argentina.
GRP allegedly breached the terms of that agreement by “failing to adequately pay” Magusa Logistics, the company hired to transport the band’s equipment from Sao Paulo, Brazil, to Buenos Aires for shows May 19-20.
“On or about May 18, 2011, in order to avoid cancellation of the shows and total financial loss, and after coming to an agreement that Defendants would promptly pay 4G the $90,000 in full, 4G instructed a third party to pay Magusa the $90,000 on behalf of 4G,” court papers say.
The equipment arrived and the concerts took place but 4G reps claim they’re still waiting for GRP to reimburse the $90,000 as promised.
The lawsuit seeks damages for breach of contract and payment agreement, fraud, promissory estoppel and vicarious liability.
