United Action Front Unlimited, which holds the band’s trademark, claims Kowalczyk – who left the group in 2009 – has been using the moniker “Ed Kowalczyk of Live” for his shows but does not have the authority to mention the band’s name.

The company, founded in 1991 by Kowalczyk, Patrick Dahlheimer, Chad Gracey and Chad Taylor, also claims Kowalczyk neglects to tell his audiences he has left the band and the performances are not linked to it, according to Courthouse News Service.

Note: Pollstar has received requests to list Kowalczyk as “Live’s Ed Kowalczyk.”

The four original members are reportedly equal shareholders in the company. United Action seeks treble damages for trademark infringement and unjust enrichment and “corrective advertising to dispel any confusion that may have been created by defendant Kowalczyk’s use of the trademark Live,” according to Courthouse News.

Kowalczyk’s representatives had no comment.
