Class Action For All-In Tix

Live Nation is the target of yet another class action lawsuit over ticketing. This time, a California man is suing to force LN to adopt “all-in” ticketing, alleging that add-on fees constitute unfair business practices and the company abuses is share of the industry to extract high fees from consumers.

Bendon Holub, in documents reported by Courthouse News Service, makes allegations that have been heard before. But in his suit, filed Oct. 5 in a Los Angeles federal court, aims to “determine once and for all if defendant’s practice of charging add-on fees is an unfair business practice and whether defendant must use ‘all-in pricing.’

 
“[Live Nation] has not made a clear, simple transaction for the consumer,” the complaint reportedly states. “Defendant continues [to] use their monopoly market power to chair unfair fees and refuses to provide consumers with a clear simple transaction through implementation of ‘all in’ pricing. 
 
“Due to lack of competition created by the merger, [Live Nation] has been non-responsive to consumer demand and has extracted unfair overcharges in the form of add-on fees to ticket prices.”
 
The suit seeks an injunction barring Live Nation from charging add-on fees and restitution under California’s unfair competition law. 
 
Since the California Central District Court has adopted policies to encourage settlements rather than expensive trials, the parties have been ordered to participate in an alternative dispute resolutions process before going to trial.
