Judge Orders Bow Wow
Refund

An Ohio judge has ruled that a school district must refund a man who sued over a canceled concert.

Guy Taylor sought $3,000 in damages from the East Liverpool school district and T&T Promotions’ Terrance Smitherman for a canceled Nov. 6 Bow Wow concert.

In an Oct. 22 ruling, Judge Byers Emmerling found both the district and Smitherman liable for refunding Taylor $170 for his tickets, according to the local Review newspaper. Tickets for the show ranged between $10 and $35.

The district’s superintendent, James Herring, pulled the plug on the concert when Smitherman reportedly failed to provide proper insurance on time.

But Emmerling noted in court that Smitherman’s contract with the district did not in fact require insurance or specify a deadline to obtain insurance, the paper said.

Smitherman never offered refunds for the show and city detectives found the promoter had used the funds on encountered expenses.

The school district does not plan to appeal the decision, the Review reported.
