Belly Up Sued Over Stage Dive

 was sued by a woman injured last year when a man dove off the stage during a concert and landed on top of her.

Named as defendants in Abbie Wade’s suit are the club and a man who allegedly injured her, according to court documents obtained by the Aspen Daily News.

Wade alleges the venue allowed the man, Andrew Stewart, on the stage putting other fans at risk.

Stewart “was allowed to dance, unimpeded, for over 20 seconds,” before he dove into the crowd, the suit says.

Additionally, Belly Up “knew, or should have known, the dangers of stage-diving and [the] potential for injury to concert attendees,” the suit continues.

Stewart was cited for assault and battery and pleaded guilty to the charges in July.

He was ordered to pay $2,374 in restitution to Wade, who suffered neck injuries, the Daily News reported.

Wade’s suit seeks many times that payment – more than $100,000 in punitive damages, attorney fees and penalties, the paper said.

The Belly Up did not respond to a request for comment at press time.

This isn’t the first suit the venue has faced in recent years.

The club was sued by a woman in 2010 for inadequate security and negligence after she was injured when a performer dragged her onto the stage during a concert.
