Court Upholds ‘Soul Men’ Dismissal
A U.S. Court of Appeal has upheld the dismissal of Sam Moore’s suit against the Weinstein Company and MGM studios over the the 2008 film “Soul Men,” its soundtrack and promotions.

Moore claimed the movie bore too much resemblence to himself and his former Sam & Dave singing partner, Dave Prater Jr., who died in 1988.
Judge Deborah Cook wrote the movie and promotions may have had some resemblance to the duo, but were different enough.
“Without a doubt, the movie added significant expressive elements to any purported use of Moore’s identity,” Cook wrote in a 16-page opinion issued Oct. 31.
