Khalifa Loses Appeal

A federal appellate court has upheld the dismissal of a suit filed by Wiz Khalifa against promoter It’s My Party and co-owner Seth Hurwitz, putting an end to a year of litigation. 

Khalifa, whose real name is Cameron Jibril Thomaz, appealed a prior district court ruling throwing out his suit claiming the promoter canceled a Dec. 6, 2012 show at George Mason University’s  at the last minute.

The complaint sought $1 million in damages, claiming the cancellation damaged Khalfia’s reputation.

I.M.P. moved for a dismissal on the basis that there was no signed contract, and U.S. District Court Judge James Cacheris agreed.

Khalifa appealed to the Fourth Circuit appellate court, which issued the dismissal Dec. 20.

“We have thoroughly reviewed the record and the relevant legal authorities and conclude that the district court did not err in dismissing Thomaz’ claim for breach of contract for failure to state a claim upon which relief could be granted,” the court wrote in upholding the dismissal.
