ICM Interns Want Class Status

A former ICM Partners intern who sued the company, claiming minimum-wage violations for unpaid work, has amended that complaint to add another plaintiff and submitted a motion for class certification.

Kimberly Behzadi added Jason Rindenau to the suit that alleges interns weren’t paid for performing work typically done by agents or their assistants, which they also say was outside the scope of an educational internship.

The purpose of the latest filing is to notify other former interns of their lawsuit in order that they may decide to join the case. ICM seeks to have Behzadi’s case dismissed on the basis of an arbitration agreement she signed when she was hired after her internship ended.

She has since left the company. Rindenau did not sign an arbitration agreement but was added to Behzadi’s suit as a proposed class representative after ICM moved to dismiss the suit.

The addition of Rindenau as a plaintiff could bolster the suit when the motion to dismiss is heard.
