Pumpkinfest Too Loud?
The annual fall festival in Turners Falls faces a $1.2 million lawsuit from a man who says he suffered severe health problems from it. Dwayne St. Marie said in his lawsuit that smoke and loud music from the 2011 installment caused a migraine and weakened his cardiac and respiratory systems, leading to a “major cardiac incident.”
St. Marie lived in an upper-floor apartment that overlooked Pumpkinfest, held in the Montague village of Turners Falls.
Organizers Michael Nelson said in his response to the suit that St. Marie’s health problems were caused by his own negligence and seeks either a trial jury or dismissal.
St. Marie claimed he closed his windows, took some ibuprofen and went to bed with a pillow over his head, only to wake up at 5:30 a.m. To a carbon monoxide alarm going off. He claims the smoke came from a vendor.
