Gillette Stadium Alcohol Policy Challenged

A federal case challenging the constitutionality of placing intoxicated fans at  near Boston into protective police custody is scheduled to head to trial later this year.

The case stems from a lawsuit filed in 2012 that alleged Foxborough police had violated state law and fans’ Fourth Amendment rights to protection against unreasonable searches and seizures.

Plaintiffs Paul Weldner, Lindsey Schmidt and Michael Burgess were taken into protective custody while entering three separate concerts at the stadium in 2011 and 2012, according to court documents obtained by the Boston Globe.

Though all admitted to drinking before the events, they claim in their suit they weren’t incapacitated and were held for anywhere from three hours to almost nine hours by police, missing the shows.

The suit is seeking unspecified damages and a change to Foxborough’s law so it matches state and federal law, the Globe reported. An attorney defending Foxborough and its chief of police told the paper the city denies the allegations that fans’ civil rights were violated.
