Festival Trial Delayed Again

The trial over the shuttering of the 2009 Summer Solstice Projekt festival near Myersville, Md., expected to start March 16, has been delayed again.

An attorney for the county. asked for a postponement because of a family emergency.

A flurry of motions and other correspondence had been filed in the case in the weeks leading up to the trial date, according to the Frederick News-Post. Promoter Dale Ihnken, who filed the multimillion suit against Frederick County in 2011 claiming “he suffered and continues to suffer harm” after county officials shut down the festival after the first of three nights over noise complaints, according to the paper.

The promoter seeks to recover his fees and costs of the ill-fated festival and the lawsuit, and punitive damages.
