TBD Hit With New Suit

An annual Sacramento music festival can add another lawsuit to its growing list of woes, as an investor is suing claiming unpaid loans.

DeWolf Emery filed suit against TBD Fest organizers Clay Nutting and Michael Hargis, along with TBD Fest LLC for $110,000 June 29. Emery claims he loaned $100,000 for the festival’s use in 2014, but says he never saw that money again and was not given stake in another company as promised. This compounds the festival’s problems, as Nutting is being sued by Katrina Arnaud, a notary who also claims her $200,000 loan was never repaid.

The Sacramento Bee reported others who helped put on the event claiming they were stiffed, and headliner Pretty Lights issued a public demand for the remainder of its performance fee last year. 2015’s shindig was headlined by Tyler the CreatorRL GrimeThe Glitch MobDinosaur Jr., Pretty LightsChance the Rapper and Chromeo.

City officials say there are no applications for permits from the festival this year.
