Wynn Sued By EEOC
The employee, a security guard, alleges that when he filed a complaint with the EEOC, the resort suspended him pending an investigation, according to the Las Vegas Review-Journal.
“We did not discriminate against the employee on the basis of an alleged disability,” a Wynn spokesman told the paper.
“Wynn Resorts profoundly resents the false accusations of the EEOC in taking this action and intends to prove that in court.” The spokesman added that Wynn was prepared to make an accommodation for the employee, who he said has not been in communication with the company for three years.
“Unfortunately, the employee was unable to obtain the certification required by government regulation which would allow us to fairly make an accommodation for him,” spokesman Michael Weaver told the Review-Journal. “The company worked with the employee for months to help him obtain the necessary medical certification. Eventually, the employee resigned; he was not terminated.”
The EEOC reportedly seeks back pay and damages, and an injunction to prevent future discrimination.
