Foos Lose Insurance Case

A Los Angeles federal judge dismissed Foo Fighters’ suit against Lloyd’s of London seeking collection of insurance claims made against the company over European concerts canceled by the band when frontman Dave Grohl broke his leg in Sweden.

The dismissal was filed Oct. 7 with prejudice, meaning it can’t be refiled later, Judge Manuel Real stated in a two-page ruling. The suit, filed June 13, claimed Lloyd’s of London and brokerage Robertson Taylor colluded to deny payment of claims for two canceled Wembley Stadium shows in London and one at BT Murrayfield Stadium in Edinburgh, Scotland.

The Foos argued that the three shows were added to a revised tour, rather than rescheduled from the original outing, which Grohl continued with a leg cast and a throne.

The term “rescheduled” was critical, as insurers are able to reduce payments for rescheduled rather than canceled shows. Also dismissed were claims for four shows canceled in the wake of terrorist attacks in Paris and a hacking of the Foos’ website the next day.

Shows were canceled in Turin, Italy; Barcelona, Spain; and in Paris and Lyon in France. The website hack included the display of a pro-ISIS message.
