Injured Fan Sues Over Guitar Toss

The complaint, filed in in Davidson County Circuit Court, alleges Shultz “consumed a significant amount of alcoholic beverages” before and during the band’s May 19, 2016, set before tossing his axe, which allegedly struck Weston Tolbert of Chicago in the face, causing “significant” injuries.
The suit claims Shultz had thrown guitars into the air and audiences before, and Live Nation – which operates Ascend Amphitheatre – failed to take precautions to prevent the incident.
Court documents also say Shultz was “guilty” of aggravated assault and reckless endangerment. The suit seeks unspecified damages not to exceed $350,000.
