Eminem – along with Limp Bizkit, Papa Roach, and Xzibit – is part of the preparing to roll through Toronto and Montreal.

Valerie Smith filed a criminal complaint with the Toronto Police Hate Crimes Unit October 4 claiming Em’s work constitutes hate propaganda under Section 319 of the Canada’s Criminal Code. The section deals with “public incitement of hatred.”

The complaint was forwarded to the Ontario provincial officials for a legal opinion. A representative from the Ministry of the Attorney General told Pollstar that the complaint has been reviewed and an opinion returned to Toronto police, but “it would be inappropriate to comment on legal advice provided by Crown Counsel.”

If the Attorney General’s office agreed the lyrics violate hate crime laws, Slim Shady will either have to clean up his act or risk arrest.

In addition, stores selling his CDs could also be ordered to stop selling his music, though the representative would not comment on what action, if any, could be expected.

Section 319 prohibits “communicating statements, other than in private conversation, [which] wilfully promotes hatred against an identifiable group.”

Smith has reportedly supplied Toronto police with examples of lyrics from Eminem’s “Kim” and “Kill You” to bolster her complaint. Some of Em’s more graphic subject matter involves murdering his wife in front of their daughter.

The code defines “identifiable group” only as one of color, race, religion or ethnic origin. However, there are federal guarantees of equal protection for women.

While there’s a resounding “no comment” coming from the rapper’s management, record label and the SkyDome, a rep from the tour’s promoter – SFX Canada – told Pollstar she was unaware of any complaint being filed, adding it’s “business as usual” in preparation for the show.

Eminem – aka Marshall Mathers III – has already had more than his share of legal entanglements this year. He faces felony weapons charges in both Warren and Royal Oak, Mich. – one of which saw a pretrial hearing postponed until December 8 – stemming from a bar fight and an altercation with an associate of Insane Clown Posse.

He’s been sued by both his mother and estranged wife for $10 million in separate defamation charges. His wife, Kim, filed her suit shortly after a suicide attempt in their home the night of his performance with the Up In Smoke tour in nearby Auburn Hills, but has since settled out of court.

Eminem has also been dogged by accusations of hate speech by various gay and lesbian support groups.
