VH Suit To Go To Trial

Nearly a year after Van Halen filed suit against the Baltimore Orioles for backing out of a concert deal, the case looks set to go to trial, the band’s lawyer said.

A district judge denied the Orioles’ motion for summary judgment August 4th, and attorney Howard King said a trial in Los Angeles District Court is “imminent.”

VH is seeking $2 million in damages from the ballclub for allegedly backing out of a deal that would have paid the band $1.5 million plus 80 percent of ticket and merchandise sales. The concert – planned for September 2004 – would have been the first ever at Baltimore’s Camden Yards.
