Just on break from a U.S. tour, bassist Brian Ritchie filed suit against lead singer Gordon Gano in a U.S. District Court in New York August 15th.

The suit claims that Gano allowed the band’s hit song, “Blister in the Sun,” to be used in a Wendy’s commercial, which tarnished the group’s reputation.

Ritchie also alleges he founded the group, claiming that he hasn’t received credit or been properly compensated for his contributions to the band.

“This action is the unfortunate culmination of an ongoing intra-band dispute between Ritchie and Gano over Gano’s misappropriation and misadministration of Ritchie’s interests in the jointly owned songs and assets of the band, misappropriation of assets solely owned by Ritchie, improper accounting and nonpayment of royalties,” the suit said.

Ritchie is apparently seeking unspecified damages, an accounting of the group’s earnings and a ruling declaring him half owner of the band’s songs.

Violent Femmes have concerts on the books in October at the NorVa in Norfolk, Va., and RFK Stadium in Washington D.C., as well as two shows at the Mohegan Sun Casino in Uncasville, Conn
