Woman Sues Over Mosh Pit Beaning

Concert mosh pits come with their own inherent risks, but getting beaned by a beverage can thrown from the stage isn’t usually considered one of them.

That’s what a Monterey, Calif., woman claims happened to her in a suit filed against Monster Beverage Co., Live Nation and All-American Rejects’ singer/bassist Tyson Ritter.

Nina Kooroshfar claims she received permanent scarring after being struck in the head by a can tossed from the stage during All-American Rejects’ set at last year’s Van’s Warped Tour at Shoreline Amphitheatre in Mountain View, Calif.

The suit, filed June 24, accuses Monster Beverage and Hansen Natural Corp. of instructing Ritter to throw large cans of the drink into the audience as a promotion. Kooroshfar “did not reasonably expect the large drink to be thrown at her at the time and could not avoid being hit by the can thrown by Ritter,” the Monterey County Herald quoted from court documents.

She was reportedly treated at the scene and received 12 stitches at Community Hospital of the Monterey Peninsula. The suit seeks unspecified damages for negligence, assault and battery, according to the Herald.
