Ark. TM Suit Halted

A federal judge has issued a stay on an Arkansas man’s lawsuit against Ticketmaster until a California class-action suit against the company wraps up.

Cory McMillan sued Ticketmaster and parent company Live Nation last year, claiming the company violated the state’s Deceptive Trade Practices Act by tacking on $50 in fees to four tickets he bought for a Jason Aldean concert at Verizon Arena.

U.S. District Judge James Moody granted TM’s motion to stay proceedings June 22 after the company argued a settlement in the California case – Schlesinger v. Ticketmaster – could very well cover McMillan and other Arkansas customers.

Attorneys for McMillan had argued the California suit didn’t cover the man as he wasn’t named as a party in the case.
Schlesinger v. Ticketmaster, which revolves around TM’s processing fees and UPS charges, has been in court for nine years. A settlement hearing is scheduled for July 24.
