U.S. District Judge William H. Haynes recently ruled that because state courts haven’t reached a decision on a contract dispute between Curb and McGraw, Curb’s federal suit alleging copyright infringement and breach of contract in federal court can not proceed, the Tennesean reported.

An appeals court ruled last year that McGraw could continue to record for a new label in the midst of court proceedings.

He released Two Lanes of Freedom on Big Machine Records earlier this year. Curb lauded McGraw’s “surge in popularity” since changing labels in a statement to the paper.

“Our No. 1 goal and intention at the Big Machine Label Group is to sign great artists with great vision and do everything in our power to create an environment for them to do their best work,” the label said.
