Carlos, along with manager David Frey, filed a suit against the band claiming they were let go of their positions without proper compensation.
Carlos claims the band refused to honor a 2010 agreement that if he stopped touring, he would remain an active member.
The countersuit, filed Aug. 30, asks the court to consider Carlos’ removal from Cheap Trick Unlimited Inc. to be valid.
Frey claims he is owed a six-figure sum from the band and is technically still the manager.
A call to Kevin Spellman, who is representing the band at Vector Management, was unavailable at press time.
