Swift Fires Back In Lucky 13 Lawsuit
Swift apparently loves the number 13, but Kloetzly says it is infringement. “Swift’s conduct has been and will continue to be malicious, fraudulent, deliberate, willful, intentional, and in disregard of Plaintiffs’ intellectual property rights,” the lawsuit says, adding the singer’s image “undeniably and squarely fits within the exact same consumer demographic” as Lucky 13’s target audience.
The lawsuit claims Swift “knows, understands and substantially profits from her carefully cultivated and meticulously managed trademarks and brand, image, and other intellectual property.”
Swift recently responded to the action, saying the California-based Kloetzly has a target audience in Orange County and there should be little confusion with the trademark, adding Kloetzly has a “failure to cure [his company’s] pleading deficiencies by alleging any facts to amplify their assertion of likelihood of confusion is readily apparent.”
Her attorneys have asked the courts to dismiss the lawsuit.
