A U.S. magistrate judge remanded Hubbard into custody until he can show he has property or cash to support granting bail, according to The Charlotte Observer.

Hubbard, a club owner in Charlotte, N.C., was indicted in 2012 after arranging a Stevie Wonder show for the University of Hawaii, which fell apart when the performer’s agency said Wonder was not involved. Hubbard has pleaded not guilty and a trial is scheduled for Aug. 25.
