Kesha Dismisses Claims

Kesha filed to dismiss her lawsuit against Dr. Luke in California alleging he emotionally and sexually abused her, but the case remains ongoing in New York.

Dr. Luke has denied the allegations, which first came about in 2014 as Kesha claimed the abuse resulted in an eating disorder causing her to be admitted to rehab, and has filed a defamation suit against her that is pending. Kesha lawyer Daniel Petrocelli said the singer is focusing on the New York case and has provided 28 new songs to Sony Music Entertainment and Dr. Luke’s label in hopes of releasing new albums and singles soon.

Two rulings in April by Manhattan State Supreme Court Justice Shirley Werner Kornreich prevented Kesha from ending her contract with Dr. Luke and dismissed the abuse claims “because the alleged incidents happened outside New York” and exceeded the statute of limitations. Kesha is appealing the decisions.

“If Kesha is voluntarily dismissing her claims in the California case, it is because she has no chance of winning them,” Dr. Luke’s lawyer, Christine Lepera, wrote in a statement.

“Kesha never should have brought her false and meritless claims against Dr. Luke in any court.” Dr. Luke has not been charged with any crime and his attorneys noted that in another lawsuit in 2011, Kesha said Dr. Luke “never made sexual advances” toward the artists nor did he ever give her a date-rape drug.

Kesha’s former attorneys say she was too intimated to say anything against the producer at that time.
