Promoters Tiff In Illinois

The promotion company runs the massive Summer Camp Music Festival, which takes place at the park every Memorial Day weekend and recently hosted acts like Widespread Panic, STS9 and Thievery Corporation among its more than 100 performers May 26-28.

This year, promoter BWT Productions is expected to produce the Tailgate N’ Tallboys Music Festival at Three Sisters Park June 24-25. Goldberg filed a motion to honor the “exclusive right to the use of the possession” of Three Sisters Park until 5 p.m. July 1, according to the Peoria Journal Star.

BWT asked for an injunction to “prevent Goldberg from doing anything to frustrate or impede preparations” for the festival. Attorneys for BWT argued that Goldberg’s rental agreement limited the promotion company’s use of the park after noon on Memorial Day to “tearing down and loading out property and equipment brought to the park” and “cleanup and removal of trash and refuse created by the event.”

Attorneys for Goldberg argued that Tailgate N’ Tallboys arrives so soon after the Summer Camp Festival that it threatens to dilute attendance and, when Goldberg’s agreement with the park expires in three years, BWT can slide into the Memorial Day weekend slot.

Peoria County Judge Kate Gorman did not find Goldberg’s speculation a matter of concern nor did Goldberg present facts to persuade her that there would be “immediate” harm by denying the restraining order, according to the Journal Star.

Goldberg has two weeks to finish cleaning up after the festival but the company is apparently well on its way to completing the task.
